‘I’m so happy I’m free’

After spending almost two years behind bars, the men accused of murdering UCT student Dominic Giddy were elated when a Cape Town magistrate acquitted them on Thursday.

Zukisani Songwaku and Simphiwe Ngoma were found not guilty of murder, attempted murder, aggravated robbery and assault with the intent to do grievous bodily harm.

Magistrate Jan van Zyl found the State failed to prove beyond reasonable doubt that the duo robbed Giddy on the night of February 13, 2010, and subsequently stabbed him to death.

A third man, Bongani Matano, was discharged when Van Zyl found a lack of evidence against him.

After court proceedings on Thursday, Songwaku and Ngoma hurried out of the court. Songwaku would not speak to the media, but he did say: “Yes we’re free, but no comment”.

Ngoma said he was happy that he was acquitted and would spend the rest of his life building a relationship with his two-year-old son.

Ngoma told the Cape Argus that his girlfriend was pregnant with his first child at the time of his arrest in 2010 and gave birth while he was in Pollsmoor Prison.

“I am exhausted… I can’t wait to see my son. I wasn’t there when he started walking and talking and when my girlfriend gave birth.”
