Western Cape police officer on trial for using K-word against colleague

Two Western Cape cops are embroiled in a legal battle as one senior police officer has now gone on trial for allegedly using the K-word on his colleague. 

According to court papers, Lieutenant-Colonel Leonard Germishuys had pleaded not guilty to the charges levelled by his coworker. 

In an extensive affidavit lodged by Sibongiseni Nogaya at the Cape Town Magistrate's Court, she describes the disagreement which allegedly led to Germishuys calling her by the derogatory term. 

The 47-year-old woman said she is employed as a finance clerk in the provincial saps office and says the incident dates back to January 2023. 

She claims the dispute arose about the filing of overtime records and Germishuys accused her of not filing the paperwork correctly as there was outstanding approval from another senior police officer.  

She states: "He went to the financial section. He took a ruler and scratched [out] the whole financial section. He wrote no funds available next to it.

"He was not looking at me all this time. He just said: ‘Your behaviour, brigadier will get rid of you very soon’. He paused for a while and then called [me] k*****.’ 

During court proceedings Germishuys pleaded not guilty and the case was postponed to 3 June for further trial. 

Defence lawyer Advocate Bruce Hendricks said: ‘My client is innocent. The record speaks for itself he was found not guilty in SAPS internal hearing and will be found not guilty again."
